1. Acceptance of Terms
By accessing this website or engaging Kubetiq Solutions ("Kubetiq", "we", "us") for services, you agree to be bound by these Terms of Service. If you do not agree, please discontinue use of the site and services.
2. Services
Kubetiq provides custom software development, AI and automation engineering, web and mobile development, cloud and DevOps services, and enterprise ERP/CRM/HRMS solutions. The specific scope, timeline and deliverables for any engagement are defined in a separate written proposal or Statement of Work (SOW), which takes precedence over this general page for that engagement.
3. Client Responsibilities
Clients are responsible for providing timely feedback, access to required systems, and accurate information necessary for us to deliver the agreed scope. Delays caused by incomplete or delayed client input may affect project timelines.
4. Intellectual Property
Unless otherwise agreed in a signed SOW, ownership of custom-developed deliverables transfers to the client upon full payment. Kubetiq retains ownership of any pre-existing tools, frameworks or internal libraries used in delivery, and grants the client a license to use them as embedded in the delivered product.
5. Payment Terms
Payment schedules are defined per engagement, typically structured around milestones. Late payments may result in a pause of active work until accounts are brought current.
6. Warranties & Support
We warrant that delivered software will substantially conform to the agreed specifications for a period defined in the SOW (typically 90 days post-launch), during which defect fixes are provided at no additional cost. Enhancements and new feature requests fall outside this warranty and are billed separately unless covered under an ongoing support agreement.
7. Limitation of Liability
To the maximum extent permitted by law, Kubetiq's total liability for any claim arising from an engagement shall not exceed the fees paid for the specific deliverable giving rise to the claim.
8. Confidentiality
Both parties agree to keep confidential information shared during an engagement private, and to use it solely for the purposes of delivering the agreed services.
9. Termination
Either party may terminate an active engagement per the notice period defined in the applicable SOW. Fees for work completed up to the termination date remain payable.
10. Governing Law
These Terms are governed by the laws of India, with courts in Gurgaon, Haryana having exclusive jurisdiction over any disputes.
